These Terms of Service (the "Terms") govern your access to and use of the Dominguard service (the "Service") operated by Dominguard ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Dominguard is a domain custody product for individuals and small teams. We scan high-traffic TLDs against your handle, register the protected domains in your name through our partner registrar, configure DNS, and turn on a redirect (Basic), a Link-in-Bio page (Pro), or email routing (Premium) on every protected domain. Features available on your account are determined by the plan you select.

2. Your account

You must provide an accurate email address and are responsible for all activity that happens under your account. Keep your authentication link and session credentials confidential. Notify us at [email protected] if you believe your account has been accessed without your authorization.

3. Acceptable use

You agree not to use the Service to:

  • violate any law or any third-party right;
  • register or claim to own a domain for which you do not have a legitimate interest, including handles that infringe a registered trademark you do not own;
  • probe, scan, or otherwise test the Service for vulnerabilities without our prior written consent;
  • attempt to overwhelm, degrade, or interfere with the Service or with other customers of the Service;
  • resell, sublicense, or make the Service available to third parties except as expressly permitted by your plan.

4. Fees and billing

Paid plans are billed annually in advance through our payment processor, Stripe. Each annual term auto-renews until you cancel. Fees for domain registrations are passed through at the registrar's published rate, billed once per domain at registration and again at each annual renewal. Service fees are non-refundable except where required by law. You are responsible for any taxes applicable to your purchase.

5. Cancellation and termination

You may cancel your subscription at any time from your account. Cancellation stops the next renewal; access continues through the end of the current annual term. Domains registered under your name remain registered to you after cancellation; you are responsible for renewing them directly with the registrar from that point on. We may suspend or terminate your account if you violate these Terms, fail to pay fees when due, or create risk or legal exposure for us. We will give you reasonable notice where practical.

6. Your content and data

You retain ownership of the domains, records, and account information you submit to the Service. You grant us the limited license needed to operate the Service: to register domains on your behalf when you request it, to configure DNS zones for those domains, to operate the redirect or Link-in-Bio or email routing on those domains according to your plan, and to send you transactional notifications.

7. Third-party services

The Service depends on third-party providers, including Stripe (payments), Dynadot (domain registrar), Cloudflare (DNS, page rules, and email routing), and Resend (transactional email). Your use of features that depend on these providers is also subject to their terms. We do not control and are not responsible for the availability of third-party services.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not guarantee that every TLD you want will be available for registration, that DNS will propagate within a specific time, that a registered domain will remain available at renewal, or that transactional emails we send will always be delivered on time. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) one hundred US dollars (USD 100) or (b) the fees you paid us for the Service in the twelve (12) months before the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill.

10. Indemnification

You will defend and indemnify us against third-party claims arising from your use of the Service in violation of these Terms or of applicable law, including claims that a domain you asked us to register infringes another party's rights.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or by a notice in the Service at least fourteen (14) days before they take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in that jurisdiction, and each party consents to personal jurisdiction and venue there.
